Background Information
The State of Delaware recently legalized recreational marijuana sales. The statute allows towns to ban the manufacture and sale of marijuana within their town limits. The statute also allows counties to regulate the activities but not ban them. Sussex County is considering what regulations it may enact.
As a private community, MBA can ban marijuana sales and marijuana establishments by amending Section 7.10 of our Restrictive Covenants. A survey circulated to the community in late August revealed, among the approximately 50% of the community that responded, over 80% support for this proposal.
Rehoboth, Dewey, Millville, Bethany Beach, and Ocean View have all banned the opening of any marijuana cultivation facility, marijuana product manufacturing facility, marijuana testing facility, or a retail marijuana store within their town limits. The towns of Lewes, South Bethany and Fenwick are also considering bans. The net effect of these towns prohibiting marijuana facilities and stores will result in the facilities and stores opening in unincorporated areas like Middlesex Beach.
MBA already bans certain types of commercial establishments in Section 7.10 of the Restrictive Covenants. For instance, bars and taverns are not permitted and there are restrictions on restaurants selling alcohol. Due to the overwhelming support shown by the survey, the Board is proceeding with the necessary steps to add marijuana establishments to the Section 7.10 list of banned commercial uses.
If you are in favor of adding this ban to our Restrictive Covenants, please vote “in favor” on THE BALLOT. An affirmative vote of at least 60% of all members is required to add marijuana establishments to Section 7.10.
