MBA Update – December 10, 2017

A petition has been brought to the Board to impose a Rental Licensing Fee, and a charge or a levy based upon the rental income generated from a rental property. Over the recent months the Board has discussed this petition and consulted with legal counsel on how to proceed. We have not reached a final decision and it would be premature for me outline a possible course of action.

Two new committees were formed in September in response to comments raised during the Fall Community Meeting by some community members. These two committees were Usage of Beach and Parking.

The Board appreciates that some Members would like more information of the current status of such petitions / proposals, particularly the petition concerning rental properties. As stated in the published Board Meeting Minutes, two MBA homeowners presented a petition to the Board with over sixty signatures wishing to establish a rental fee applicable to all rental properties in the community. The Board informed the members that they (the Board) needed to contact the Board’s attorney to determine the legalities of how to proceed.

The Board sent the Board attorney a letter asking for an opinion on what is required based upon our By-Laws and Covenants.

At the November 11 Board Meeting, Jeff Sella informed those present that the Board had received the attorney’s response. A Member inquired about the opinion received to which the Board informed them it could not yet be released as it was attorney-client privilege material. The Legal committee has sent a list of clarifying questions to the attorney. Once all concerns, questions, and issues have been addressed, the Board will have the attorney draft a final letter to the community explaining the steps that must be taken. The Board will be meeting this upcoming Saturday, December 16, which is open to all community members wishing to attend.
