Traffic/Vehicle Regulations
Adopted June 2018
Overview:
Violations that may result in immediate towing of a vehicle:
Any vehicle determined by the Middlesex Beach Association (“MBA”) to be in violation of any of the following traffic/vehicle violations may, without notice and for a first offense, be towed if:
- Blocking a road;
- Blocking beach crossing access;
- Blocking a driveway;
- Blocking a fire hydrant;
- Parked in a Fire Lane;
- Abandoned and/or inoperable and parked on road.
Violations that may result in a notice of violation/fine, and which may result in towing for any subsequent violation:
Any vehicle determined by the MBA to be in violation of any of the following traffic/vehicle violations may, after receiving notice of violation for a first offense and upon the occurrence of a second offense within a six (6) month period from the first offense, be towed if: • Invalid or lack of a valid MBA-issued parking pass;
- Parked in an MBA No Parking zone, such as those on Beach Plum Road, or otherwise parked illegally on a road as marked where not specifically identified above; • Parked in a place and/or manner that creates a nuisance or safety issue not identified above;
- Any other reason deemed necessary at the discretion of the MBA Board of Directors (“the Board”) and/or Community Patrol (“CP”) Committee Chair, and/or CP Supervisor (“Supervisor”).
Parking Violation History:
The MBA shall maintain a record of all vehicles that have violated MBA rules and regulations, including, but not limited to, this towing policy. Additionally, this record shall include all enforcement actions taken as a result of any violations.
Liability:
The Board, Committee Chairs, property manager(s), Supervisor(s), and CP staff assume no responsibility for any damage to or theft from any vehicle.
Towing Fee:
All towed vehicles will be towed at the owner’s full expense. The MBA assumes no responsibility for any towing or storage expenses.
Fines and Penalties:
In addition to towing a vehicle, monetary fees and penalties may also be assessed by the Board for any traffic/Vehicle violations identified above. In the event the Board imposes a monetary fine or penalty, notice and an opportunity to be heard before the Board shall be given in accordance Section 12.1 and Section 12.2 of the MBA Restrictive Covenants.
